Terms of use
Last updated October 23, 2026
These terms are an agreement between you and Birfy LLC (“Birfy”, “we”). By making a party page or replying to one, you agree to them. Please also read our privacy policy.
Using Birfy
- You must be at least 18 to create or co-host a party page. Replies should come from a parent, guardian or other adult.
- Keep your email account secure: anyone who can open your email can sign in to your Birfy account.
- Birfy is free right now. If we add paid features, we'll tell you the price before you pay anything.
Your content
You own what you put on Birfy: party details, notes, photos and wishlists. You give us permission to store it and show it to the people you share your link with, only as needed to run Birfy. This permission ends when you delete the content, except for copies kept briefly in backups.
You're responsible for what you post. Only add a child's name or photo if you're their parent or guardian or have their permission, and don't post anyone else's private information.
Party links
Anyone with your party link can open the page. Share it only with people you're inviting. If a link reaches the wrong people, you can cancel or delete the party at any time.
Co-hosts
- A host can invite other adults to co-host a party by email. Co-hosts can change the party and see every guest reply, including notes and contact details. With full access, they can also cancel the party. Only the host can delete the party or change co-hosts.
- Invite only people you trust. You're responsible for who you invite, and you can remove a co-host at any time.
- If you co-host, these terms apply to you too, including the rules on content. Use guests' information only for the party. You can leave a party at any time.
Gifts and money
Birfy doesn't process payments and is not a party to any payment. If a host shows Venmo or Zelle details, any money is sent directly between guest and host through those services and under their terms. Wishlist links go to other stores; we don't sell those products and aren't responsible for them. Reserving a gift on Birfy is a courtesy to avoid duplicates, not a purchase.
Gift ideas: Birfy suggests gift ideas that hosts can add to their wishlist. Links to these ideas may be affiliate links, which means Birfy may earn a commission when someone buys through them, at no extra cost to the buyer. Prices and availability are set by the store.
Things you can't do
- Use Birfy for anything illegal, hateful, harassing or sexually explicit.
- Send spam, or create pages that aren't real party invitations.
- Try to access parties or accounts that aren't yours, or get around our security or spam protection.
- Copy, scrape or overload the service with automated tools.
We may remove content or suspend accounts that break these rules.
Changes and ending the service
Birfy is new and will keep changing. We may add, change or remove features. You can stop using Birfy and delete your account at any time. If we ever shut Birfy down, we'll email hosts at least 30 days ahead.
No guarantees
We work hard to keep Birfy running and accurate, but it's provided “as is”. We can't promise it will always be available or free of errors, and we're not responsible for the parties themselves: the event, the venue, gifts, payments between families or what guests do.
Limits on liability
To the extent the law allows, Birfy won't be liable for indirect or consequential losses, and our total liability for any claim about the service is limited to $100. Some places don't allow these limits, so they may not apply to you.
Disputes
If something goes wrong, email us first at team@birfy.com and we'll try to sort it out. These terms are governed by the laws of the State of New York, in the United States.
Changes to these terms
If we change these terms, we'll update the date at the top, and for important changes we'll email hosts before they take effect. Using Birfy after a change means you accept the new terms.
